In all other states, we act as an authorized loan broker connecting you with licensed third-party lending partners.

3. Eligibility 

To use this Site and our services, you must: 

  • Be at least 18 years of age 
  • Be a legal resident of the United States 
  • Have the legal capacity to enter into a binding agreement 
  • Not be prohibited from using this Site under applicable law 

Loan availability, terms, and products vary by state. Our lending and brokerage activities are subject to state licensing and regulatory requirements.

11. Dispute Resolution 

Informal Resolution First 

Before filing any formal claim, you agree to contact us to attempt to resolve the dispute informally. Email us at legal@montanacapital.com with a description of your concern. We will try to resolve the matter within 30 days. 

Binding Arbitration 

If we cannot resolve the dispute informally, you and Montana Capital agree that any controversy or claim arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. 

Key arbitration terms: 

  • Arbitration will be conducted by a single arbitrator in Los Angeles County, California 
  • The arbitrator’s decision will be final and binding 
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction 
  • Each party shall bear its own attorneys’ fees 

Class Action Waiver 

YOU AND MONTANA CAPITAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 

Small Claims Court Option 

Notwithstanding the above, either party may bring an individual action in small claims court in the California county where you reside (if you are a California resident) or in Los Angeles County, California. 

Federal Arbitration Act 

This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). 

12. Governing Law 

These Terms and any disputes arising from your use of this Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. 

13. Third-Party Links 

This Site may contain links to third-party websites for your convenience. We do not control these external sites and are not responsible for their content, privacy practices, or terms of use. Linking to a third-party site does not imply endorsement. You access external websites at your own risk.

15. USA PATRIOT Act Notice 

Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account or applies for a loan. When you apply, we may ask for your name, address, date of birth, Social Security number, and other identifying documents. 

16. Termination 

We may terminate or suspend your access to the Site at any time, without prior notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease. 

Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.
