This Electronic Consent Agreement (“Agreement”) explains how Simple Cash Loans, Inc., doing business as Montana Capital Car Title Loans® (“Montana Capital,” “we,” “us,” or “our”) may provide you with disclosures, notices, and other communications electronically, in accordance with the Electronic Signatures in Global and National Commerce Act, 15 U.S.C. § 7001 et seq. (the “E-SIGN Act”).

1. Definitions

• “We,” “us,” and “our” refer to Montana Capital Car Title Loans® and its affiliates.

• “You” and “your” refer to the person consenting to receive electronic communications.

• “Communications” means any disclosures, notices, agreements, fee schedules, statements, records, documents, and other information we provide to you or that you sign or submit.

2. Scope of Consent

By consenting to this Agreement, you agree to receive the following types of Communications electronically:

• Loan applications, disclosures, and agreements

• Truth in Lending disclosures and periodic statements

• Privacy notices and policy updates

• Account statements and payment confirmations

• Notices regarding changes to terms or fees

• Collection notices and account status updates

• Any other Communications related to your loan or account

3. How We Provide Electronic Communications

We may provide Communications to you electronically by one or more of the following methods:

• Email: Sent to the email address you provide

• Website or Customer Portal: Posted to your secure account accessible at montanacapital.com

• Text Message (SMS): If you have opted in to receive text messages

4. Hardware and Software Requirements

To access and retain electronic Communications, you will need:

• A computer, tablet, or smartphone with internet access

• A current web browser (Chrome, Safari, Firefox, or Edge)

• Software to view PDF files (such as Adobe Acrobat Reader, available free at get.adobe.com/reader)

• A valid email address

• Sufficient storage space or a printer to save or print Communications for your records

If our hardware or software requirements change in a way that creates a material risk you will not be able to access or retain Communications, we will notify you and provide you with a statement of the revised requirements.

5. Your Right to Paper Copies

You have the right to receive a paper copy of any Communication we provide electronically. There is no fee for requesting paper copies. To request a paper copy, contact us using the information in Section 9 below.

6. How to Withdraw Your Consent

Your consent to receive electronic Communications is voluntary and not required as a condition of applying for or obtaining any product or service from us.

You may withdraw your consent at any time by contacting us using the information in Section 9 below. Withdrawal of consent will be effective within 10 business days of our receipt of your request. There is no fee to withdraw your consent.

If you withdraw your consent, we will begin sending Communications to you in paper form. However, withdrawal of consent will not affect the legal validity of any electronic Communications provided before your withdrawal became effective.

7. Keeping Your Contact Information Current

It is your responsibility to keep your email address and other contact information current with us. If your email address changes, please notify us immediately by contacting us at legal@montanacapital.com or by calling 818-503-9393.

8. Federal Law

This Agreement is governed by the Electronic Signatures in Global and National Commerce Act, 15 U.S.C. § 7001 et seq. (the “E-SIGN Act”), which gives electronic signatures and records the same legal effect as written signatures and paper documents when certain requirements are met.
